Terms of Service
These Terms govern Neptivum, the private captain’s logbook operated by SIA CrowFoundry.

1. The service
Neptivum records vessels, voyages, positions, crew events, maintenance, documents, costs and port activity. It works offline and may synchronize an account’s records to private cloud storage. You retain ownership of the records and files you enter.
Neptivum is not a primary navigation instrument, chartplotter, collision-avoidance device, AIS receiver, anchor alarm, weather-routing service, emergency service or approved statutory logbook. Never rely on it as the sole or primary source for navigation, safety of life, regulatory compliance or watchkeeping alarms. Always use approved charts and onboard instruments, official notices and forecasts, and prudent seamanship. The skipper remains responsible for navigation, vessel safety and compliance. Verify important entries and transfer them to an official or paper record where required.
2. Accounts and acceptable use
Cloud accounts are available from age 18. New registration screens require separate 18+ and current-rules confirmation before email or social account creation. Older installed clients receive a temporary registration transition until the updated store releases are available; no age confirmation is inferred from their existing agreement. Existing accounts retain server sign-in, recovery and deletion access. Local recordkeeping is available without an account or an adult declaration. You must have legal capacity or the required guardian authority for purchases under your local law and store rules. You must provide accurate account details, protect your credentials and promptly report suspected compromise. Do not use the service for unlawful content, unauthorized surveillance, infringement, malware, abuse or attempts to access another account. You must have the right and an appropriate lawful basis to enter vessel, document and crew information.
Technical reporting rule. Scrubbed technical error reporting defaults on after acceptance of these current terms and a separate 18+ declaration, only when the operational privacy assessment and processor controls are complete. Existing off choices stay off. The reporting switch is available only in More → Settings. Reporting includes error types, package code locations and app/build information; it excludes vessel/location/crew/account content and identities, private paths, request contents and attachments. Optional performance durations remain off until a separate explicit Settings choice. Accepting these terms is not diagnostic consent. 3. Pro purchases, invoices and cancellation
Neptivum offers monthly, annual and lifetime Pro choices through direct Stripe web checkout and may offer equivalent choices through Apple App Store or Google Play. The checkout provider displays the binding price, applicable taxes, renewal terms and payment method before purchase. Monthly and annual plans renew automatically until cancelled. Web subscriptions and their PDF invoices are managed through the Stripe customer portal; store subscriptions are managed in the applicable store. Deleting Neptivum does not itself cancel a subscription.
“Lifetime” means access for the commercially supported lifetime of the Neptivum product and service, not the lifetime of the purchaser. It is a one-time purchase. Mandatory consumer cancellation, withdrawal, refund and conformity rights remain unaffected. Immediate access does not itself waive an applicable withdrawal right; any lawful digital-content waiver requires a separate express request and acknowledgement at checkout. Use the relevant store refund/withdrawal controls, or contact legal@neptivum.com for direct purchases. We provide applicable durable purchase confirmation through the checkout provider. Covered EU online purchases require the statutory online withdrawal function; its operational implementation must be completed before such sales are offered. After Pro expires, the app aims to keep existing local records readable and exportable while Pro-only cloud or advanced features may stop.
4. Weather, AIS, maps and calculated information
Maps, positions, imported AIS particulars, weather observations and forecasts, wind and sea-state data, distances, courses, speeds, sea-time totals, summaries and predictions may be unavailable, delayed, stale, incomplete, inaccurate or wrong. They are supplementary recordkeeping and planning aids only. Confirm all safety-relevant information using current official sources and approved onboard equipment.
YOUR USE OF REAL-TIME WEATHER GUIDANCE IN THE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER AND MARINE DATA MAY NOT BE ACCURATE OR AVAILABLE.
5. Availability and offline data
We do not guarantee that the app or any cloud, synchronization, map, positioning, AIS, weather, email or store service will be uninterrupted, timely, accurate, complete, secure or available. Offline and cached information may be stale. Core logging is designed for offline use, but you are responsible for checking synchronization status, maintaining device backups and sufficient storage, and exporting important records. We may change features for security, law, platform requirements or product development while respecting paid consumer rights.
6. Intellectual property and feedback
SIA CrowFoundry owns Neptivum’s software, design and branding. Your logbook content remains yours. You grant us only the limited rights needed to store, transmit, transform and export it at your direction. Voluntary product feedback may be used to improve the service without identifying you publicly.
7. Suspension and deletion
You may delete your account from the app. We may restrict an account where reasonably necessary for security, abuse, non-payment or serious breach, and will provide notice where appropriate. Account deletion is described on the Account Deletion page and in the Privacy Policy.
8. Liability
To the extent permitted by law, Neptivum is provided on a reasonable-care, best-effort and “as available” basis, without a guarantee of availability or accuracy. SIA CrowFoundry is not responsible for navigational or operational decisions, missed or delayed alarms, unavailable or inaccurate app or third-party data, unsafe vessel operation, failure to use an approved primary navigation instrument, or failure to keep legally required records. You assume the risk of relying on the app or its data as a supplementary aid. Nothing excludes liability that cannot legally be excluded or limits mandatory consumer rights.
9. Law and contact
